Dear Chris,

I’ve got a guy who’s a contractor heading to help with hurricane clean up. Will his policy cover him?

Thanks for your help!

– Territory Turmoil

Dear Territory Turmoil,

This is a great question, but unfortunately I can’t give you an easy yes or no answer. If you’re referring to his GL policy, the ISO coverage territory includes the United States of America, its territories and possessions, Puerto Rico, and Canada. However, especially in E&S policies, there are often additional coverage territory limitations. For example, a territory we commonly see excluded or restricted in our area for contractors is SC because many carriers view it as a Construction Defect state. So you will really just have to look at the policy forms closely to see if they have coverage in TX, FL, Puerto Rico or wherever else they may be going to work.

If you’re asking about their auto liability and/or physical damage policy, again you’ll have to read the forms carefully. The ISO auto liability coverage territory includes the United States, its territories and possession, Canada, and Puerto Rico; however, many physical damage policies, especially on the E&S side, only cover vehicles while in the contiguous 48 states and Canada. Therefore, there would be no coverage in Puerto Rico, but they would have coverage in TX and FL.

I feel like I haven’t really answered your question, but the truth is you’ll just have to read the specific coverage territory definition for the policy in question, and pay attention to any additional exclusions that may restrict coverage in a certain area.

XOXO

Chris
